Under changes in the law implemented in 2014, anyone wishing to make an Employment Tribunal claim must first notify ACAS.  ACAS will then endeavour to use its free Early Conciliation(EC) service to try and resolve the dispute without parties progressing with legal action.

In the first year of the scheme ACAS report that between April 2014 and March 2015 they dealt with over 83,000 early conciliation cases with three-quarters of employees/employers agreeing to engage with the scheme.

The research also showed:

  • Between April and December 2014, 63% of EC notifications received did not proceed to a tribunal claim;
  • A further 15% resulted in formal settlement;
  • With only 22% progressed to a tribunal claim

Independant research points to 80% of participants in EC being satisfied with the service they have received from ACAS.
