At 9.29am on 16th December 2021 perhaps the shortest statutory instrument was made and came into effect on 17th December 2021 in Scotland, England and Wales.

 

The Statutory Sick Pay (Medical Evidence) Regulations 2021have temporarily changed the length of time an employee can self-certify from 7 calendar days to 28 calendar days regardless of the number of days they work. Your employee will only therefore be required to attend to see their GP, and obtain a ‘fit note’, should their sickness absence extend beyond 28 days.

 

These Regulations have retrospective effect and mean anybody sick before 10 December 2021 come within the old Regulations, and can self-certify for 7 days, and those who are sick on or after 10 December 2021 can self-certify for 28 days.

 

The intention behind these Regulations is to relieve the burden on GPs in the next few weeks and they are only due to apply to sickness absence which commenced on 10 December 2021 to 26 January 2022 inclusive though this may well be extended subject to the environment we are faced with at the end of January 2022.
